Constitution

The constitution of the United States of America is based on establishing Justice, a perfect union of States, providing human rights to the people, and also the welfare of people, providing common defense, and securing the liberty of the country.

 The Constitution of the United States Consists of:

  1. A preamble
  2. Total Articles: seven  (7)
  3. Amendments: Twenty-Seven ( 27)

Article 1 ( Legislative Branch/Congress)

All legislative powers shall be vested in the Congress of the U.S.A . It consists of the Senate and House of representatives.

The House of representatives is composed of members chosen every second year by the people of several States. Electors in each State shall have Qualified requisites for Electors of the most numerous branches of the state legislature.

The Senate of the United States is composed of two Senators from each State for 6 years.

  • Powers Vested in Congress

All bills for raising revenue shall originate in the House of Representatives. All other bills can originate in Senate.

Article 2 ( Executive Branch)

The executive Power is vested in a President of the United States of America. He holds office for 4 years together with Vice President chosen for the same Term elected.

The President shall be the Commander in Chief of the Army and navy of the United States and the militia of several States.

  • Consists of the president and other executive officers
  • President is elected for 4 years along with a vice President. Electors choose president
  • President is the Commander in Chief of the military.

Article 3 (Judicial Branch)

The Judicial Power of the United States shall be vested in one Supreme Court and inferior Courts.

  • Nine Justices including one chief justice. All justices can continue their office as long as they have "good behavior".
  • Jurisdiction: Both appellate and original. Justice John Marshall asserted the RIGHT OF "Judicial review" in the Madison vs Marbury case (1803).

Article 4

Full Faith and Credit shall be given in each State to Public Acts, records, and Judicial Proceedings of every State. 

The citizens of each State shall be entitled to all privileges and Immunities of Citizens in several States. 

The United States shall guarantee to every State in this Union a Republican Form of Government/

  • Relations between states and between States' Federal government

Article 5

  • 2/3 majority of both houses is required for amendment in the constitution. Also, subsequent ratification by 2/3 state legislatures is required.

Article 6

  • Establishes the constitution as the supreme law of the land. Forbids any religious test for holding a government office.

Article 7

  • How many state ratification is necessary for the constitution to take effect and how a state can ratify.


Amendments: Twenty-Seven ( 27)

The preamble to the Bill of Rights 

The Congress of the United States was held in the city of New York.

  1.  Prohibits the making of any law respecting an establishment of religion, impeding the free exercise of religion, etc.
  2. Right of the people to keep and bear arms.
  3. Prohibits peacetime quartering of soldiers
  4. Guards against unreasonable searches and seizures
  5.  Protects against abuse of government authority in a legal procedure.
  6.  Ensure due process.
  7.  Right to trial by a jury in certain civil cases.
  8.  Curtails the federal government's power from imposing excessive bail, excessive fines, or cruel and unusual punishments. 
  9.  The enumeration of certain rights in the constitution shall not be construed to deny or disparage others retained by the people.
  10.  Powers not delegated in the constitution shall remain with either the states or individuals.
  11.  In 1804 this amendment fixed the defect exposed in the 1800 election
  12.  Abolished slavery in 1865.

The first 10 amendments are known as the " Bill of Rights"

 The Congress of the United States was held in the city of New York. The Conventions of several states adopt Constitution to prevent misconstruction or abuse of its powers. Declaratory and restrictive clauses should be added for public confidence in the Government to ensure the benefits of institutions.

Amendment 1

Congress makes no law respecting or establishing a religion or prohibiting the free exercise of freedom of speech. The rights of people to assemble and petition the government to redress grievances.

Amendment 2

A well-established militia is necessary for the security of a state. The right of people to keep arms.

Amendment 3

No soldier occupies the house in times of peace without the consent of the Owner nor in times of war.

Amendment 4

The rights of people secured, houses, and papers against unreasonable searches and shall not be violated.

Amendment 5

No person is answerable for capital or crime unless indictment by Grand Jury.

Amendment 6

In all criminal prosecutions, the accused shall enjoy the right of a speedy and public trial by an impartial jury.

Amendment 7

In suits at common law, the value in controversy shall exceed 20 dollars. The right of the trial of a jury shall be preserved. The jury shall examine in any court of the United States according to the rules of common law. 

Amendment 8

Excessive bail shall not be required nor excessive fines imposed nor cruel and unusual punishment inflicted.

Amendment 9

The enumeration in the Constitution of creating rights should not be construed to deny others retained by people.

Amendment 10

The powers not delegated to the United States by the constitution nor prohibited by states are reserved for the people.
